Our Process
STEP ONE To begin assessing your individual needs, we meet with you in-person here at our office and assist you in completing a Debt Relief Questionnaire that will help us decide how to best serve you.
STEP TWO This requires you to complete a Checklist for our Second Meeting that includes preparing forms, gathering documents and raising whatever funds you may need.
STEP THREE Our Legal Assistants will then review your information and enter it into our database, making sure to follow-up with you as needed to ensure that your information is correct.
STEP FOUR At this point, your lawyer will analyze the information that you have provided and prepares a set of options that will benefit you the most. This may or may not include filing for bankruptcy.
STEP FIVE If bankruptcy is necessary, we conduct a Final Review of your Bankruptcy Petition and file the petition online along with the related documents.
Chapter 13 Only If a Chapter 13 Bankruptcy is required, you will need to mail your first Plan Payment no later than 7 days before your Court Date. You must also continue making payments on your house.
STEP SIX
This step involves your appearance in Court to answer 3-4 minutes of questions from the Trustee and usually occurs 4-6 weeks after filing your Bankruptcy Petition. Though creditors may also ask questions, they usually do not attend.
STEP SEVEN If applicable, you will be required to turn over Excess Property to a Bankruptcy Trustee plus undergo Money Management courses online.
STEP EIGHT - Chapter 7 In the event that you have filed Chapter 7 Bankruptcy your debts will be discharged after 60-90 days after meeting with the Creditors.
STEP EIGHT - Chapter 13 In the event that you have filed Chapter 13 Bankruptcy you will receive a Confirmation Hearing 60-90 days after filing which you do NOT need to attend. You will need to continue making payments until you satisfy the requirement of your Plan Payment and the rest of your debt will be discharged.
